What is Mediation?

  • Mediation is an informal confidential process in which an impartial third party helps disputing parties resolve their dispute by developing a mutually acceptable agreement between the parties.
  • The impartial party, known as the mediator, may suggest alternatives for the parties to consider, but the parties decide on their agreement.
  • The mediator does not impose an agreement on the parties, nor does the mediator decide the matter in dispute.
  • Mediation is NOT court or arbitration. While mediation can be part of the litigation process, litigation does not have to be pending for mediation to be appropriate.
  • Any time parties have a dispute. Mediation is a valuable tool to be utilized to resolve the dispute.
  • The mediation process is non-adversarial. The objective is for the parties to create their own mutually acceptable agreement based upon their interests, needs, and values through encouragement and facilitation.
  • During mediation, the decision-making authority rests with the disputing parties.
  • The mediator's role is to assist the disputing parties in identifying issues, facilitating communication, focusing the parties on their interests, exploring alternatives with the parties, and helping the parties reach a voluntary agreement.
